General terms and conditions
Art 1 Scope
These general terms and conditions govern the contractual relationship established between the purchaser and the Schöneben AG through the purchase of various tickets for the use of the lifts and associated infrastructure of Schöneben AG. This applies both to tickets purchased on-site at the ticket office (at the valley stations of the Haideralmbahn and the Piz-Schöneben cable car – opening hours are published on the website: www.schoeneben.it) and to tickets purchased through the online shop of the Schöneben AG.
Unless otherwise provided by these terms and conditions or by other terms and conditions applicable to specific tickets, these terms and conditions apply to all tickets valid for Schöneben AG's infrastructure. The Terms and conditions define the rights and obligations of users in connection with the use of the purchased tickets.
Art 2 Territorial scope of tickets
The territorial scope of the purchased tickets depends on the ticket type. Information on the individual ticket types can be found on the Schöneben AG website.
Art 3 Subject matter of the contract
The tickets, to which these general terms and conditions apply, are personal and may only be used by the holder. Therefore, the ticket may not be transferred, either for a fee or free of charge. Furthermore, the ticket may not be exchanged or tampered with.
Once the purchase has been completed at the ticket office or in the online shop, the ticket can no longer be changed.
Purchased tickets are only valid for the season (summer or winter) in the year in which the respective ticket was purchased. The season times are published on the Schöneben AG website. Schöneben AG reserves the right to delay the opening or closing of the lifts due to extraordinary circumstances, or even to temporarily close them during the current season.
At the beginning and end of the season, the closure of individual lifts and the restriction of accessible slopes/trails is possible due to visitor numbers, snow conditions, and safety concerns.
Purchasers acknowledge that the decision to open lifts and slopes/trails is made at Schöneben AG's discretion, taking into account the energy market situation and the unpredictable development of energy supply costs. This may result in the purchased tickets being usable only to a limited extent or not at all, as the offer may be reduced for the reasons stated in these general terms and conditions, which cannot be objected to by purchasers. Purchasers are aware of and assume this risk. The exclusion of any form of refund, compensation, or indemnity is accepted by the purchaser.
If the offer must be restricted due to legal regulations enacted after the purchase, the purchaser of the affected ticket bears the risk and is not entitled to a refund of the ticket price. In this case, withdrawal from the purchase contract is excluded.
Art 4 Restrictions on the offer due to circumstances beyond Schöneben AG’s control
The uninterrupted operation of the lifts throughout the entire season, as well as the accessibility of all slopes/trails, cannot be guaranteed if this depends on circumstances beyond Schöneben AG's control. In these cases, the purchaser is not entitled to a refund of the ticket price. Withdrawal from the purchase contract is excluded in this case.
In the event of partial or total subsequent impossibility of Schöneben AG to provide the service, the purchaser is not entitled to a refund of the ticket price, contrary to Articles 1463 and 1464 of the Italian Civil Code. Withdrawal from the purchase contract is excluded in this case.
Art 5 Prices
Prices are published on the Schöneben AG's website. Schöneben AG reserves the right to change prices at any time. However, this will not affect tickets already purchased and not yet used. This will only affect tickets purchased after the price change.
For children who receive free tickets according to the terms and conditions stated on the website, these tickets are only granted if purchased in combination with an adult ticket for the same period. An adult ticket can also be combined with multiple child tickets. To receive a free ticket, the applicant must present appropriate identification to confirm that the conditions are met.
If the ability to work is reduced by 60% or more due to a physical impairment, the child rate is granted.
If a change in applicable legislation results in elements of the price changing so that it becomes more expensive, Schöneben AG has the right to pass on the price increase to the purchaser up to the point at which the ticket has been used.
Art 6 Purchase
Purchases can be completed directly at the ticket office. Schöneben AG can also provide appropriate devices that allow buyers to purchase tickets themselves, without the assistance of a Schöneben AG employee.
Tickets are loaded onto a keycard/keytix upon purchase, which then allows passage through the turnstiles. If the purchaser already has a keycard, this can be used. Otherwise, a new keycard can be purchased on-site and reused for future purchases.
Art 7 Online Purchase
As an alternative to purchasing tickets on-site, selected ticket types are also available in the Schöneben AG online shop. This shop is linked to the Schöneben AG website.
The online shop uses dynamic pricing, meaning tickets purchased earlier are generally cheaper than tickets purchased later. The price depends on various factors. This remains the case until the quota for discounted tickets is exhausted. However, the maximum price in the online shop is always lower than the price for which the tickets are sold on-site at the ticket office. The price is calculated for each order by the system running the online shop and displayed to the buyer before the final purchase. Dynamic pricing is not available at the on-site ticket offices. There the same price applies at all times. This also applies in cases where the online shop is out of service or malfunctions for other reasons.
In order to shop in the online shop, the buyer must register. After purchasing the ticket, the buyer will receive a confirmation via email. This confirmation contains all the necessary information for picking up the ticket on site at the box office or at a corresponding machine, where the ticket will be loaded onto a keycard/keytix. If this confirmation cannot be presented when picking up the ticket, no ticket can be issued. Alternatively, the buyer has the option of specifying a keycard that they already have when making the purchase, which the ticket will then be loaded onto as soon as they pass through a Schöneben AG turnstile for the first time.
The ticket is valid, regardless of the type of purchase, for the season (summer or winter) of the year in which the ticket was purchased. Changes to the ticket after purchase are excluded. The right of withdrawal set out in Articles 52 et seq. Legislative Decree No. 206/2005 is in accordance with Art. 59 para. 1 lit. n) Legislative Decree No. 206/2005 excluded.
When purchasing online, cancellation insurance can be purchased at the same time as the ticket purchase. The price is displayed in the online shop. This allows for free cancellation of the ticket up to four days before the first day of ticket validity. After that, cancellation is absolutely impossible. The cost of the cancellation insurance is non-refundable.
The online purchase is invalid in the following cases:
a) if the online payment is cancelled for various reasons and the payment fails or
b) if the payment is incorrect or incomplete, so that the amount is not debited from the account.
In these cases, the provisional reservation will be canceled and the purchase will be invalid.
Art 8 ski depot
In addition to purchasing a ski ticket, a ski depot can be rented. The ski depots are located at the valley stations of the Haideralmbahn and the Piz-Schöneben cable car. Access is only possible with a valid ski pass. A corresponding fee must be paid to Schöneben AG for use, which is published on the website.
Art 9 Replacement or refund of tickets
Purchased tickets cannot be refunded, exchanged, or replaced, except as provided in the general terms and conditions. This also applies to tickets that have not been used or have only been partially used, confiscated, canceled, or deliberately damaged.
Art 10 Loss of the ticket
In place of lost, damaged, or accidentally damaged tickets, duplicates for the same period can be issued at the ticket office. However, this is only possible if the ticket owner can prove their ownership (e.g., through the receipt received at the ticket office) and if the ticket in question can be identified (e.g., through a photo of the ticket showing the ticket number).
Art 11 Reimbursement in the event of a skiing accident
In the event of a skiing accident, a refund of the ticket is possible, but only for all unused days. This refund is only available to the injured person. To receive a refund, a corresponding request must be submitted within 15 days of the skiing accident. This can be done either by presenting a medical certificate together with the relevant ticket and an identification document of the injured person at the ticket office on site or by sending these documents by email to Schöneben AG (info@schoeneben.it). The request can also be made by someone other than the injured person, provided that this person has been authorized to do so by the injured person.
If the injured person has insurance that also reimburses the unused portion of the ticket in the event of a skiing accident, Schöneben AG cannot provide a refund.
Accompanying persons are not entitled to a refund of the ticket.
The amount of the refund is determined by the purchase price of the ticket minus the ticket office price for the days of the ticket used.
Art 12 Obligations of the buyer
The ticket holder acknowledges that he is obliged to comply with the applicable legal provisions, in particular the obligation to take out liability insurance to cover damage or injuries to third parties for the period in which the ticket holder is travelling as a skier, snowboarder or similar.
The purchaser of tickets for minors declares that they are familiar with the regulations regarding the duty of supervision of minors. Furthermore, the purchaser acknowledges that minors under the age of 18 are required to wear a protective helmet that complies with applicable law. This may be checked by the relevant authorities and will be punished with the appropriate penalties.
In order to take advantage of the offers associated with the ticket purchase, it is essential that you carry your ticket with you. It must be validated at the turnstiles at the lift access points (this is done without direct contact on the left side of the body). The ticket holder is required to present the ticket along with appropriate identification when checked by Schöneben AG employees, so that they can verify that they have a valid ticket.
Ticket holders are obligated to comply with the regulations established by Schöneben AG. These regulations may be posted in the form of signs or similar forms. They may also be published on the website.
The ticket holder rides (on skis, snowboards, bicycles or similar) at his own risk.
The choice of route and skiing style must be adapted to personal abilities, terrain conditions, snow conditions, weather, and visibility, as well as to the operating hours of the lifts. The classification of the slopes on ski maps is purely a recommendation.
For safety reasons, it is prohibited to stay on the ski slopes outside of operating hours during the winter season. Violators are liable under both civil and criminal law for damages caused by violating this rule.
Art 13 Liability
In the event of improper or unauthorized use and in the event of unauthorized acts relating to the technical facilities, the ski slopes, the trails, the hiking trails and all associated objects and the surrounding areas for which the ticket is valid, Schöneben AG shall not be liable.
Any liability of Schöneben AG for damages caused by another company for whose services the same tickets apply as for the services provided by Schöneben AG is also excluded, even if the ticket in question was purchased at a Schöneben AG sales outlet, regardless of whether the purchase was made online, at the ticket office on site, at a corresponding vending machine or at another Schöneben AG sales outlet.
Art 14 Misuse of the ticket
Any form of ticket misuse may result in immediate confiscation and cancellation of the ticket. If the free ticket for children is used by persons who are not entitled to it, a penalty payment to Schöneben AG will be made equal to the cost of an adult ticket of the same type for the same period. However, no valid ticket will be issued and the free ticket will be confiscated and canceled.
Tickets may also be withdrawn and cancelled by the competent supervisory authority in the event of a breach of applicable law.
The buyer acknowledges that improper use of the ticket may also result in civil and criminal consequences.
Art 15 Other provisions
The ticket fulfills the requirements of a tax receipt and must be retained for the entire duration of use.
By purchasing or using the ticket, the purchaser or user of the ticket declares that they are familiar with and accept the general terms and conditions.
In the event of any ambiguities or discrepancies between the different language versions, the German version of the general terms and conditions shall prevail.
Art 16 Applicable law and jurisdiction
In any judicial or extrajudicial procedure replacing a judicial procedure which has as its subject-matter these general terms and conditions, unless otherwise provided by legal norms which cannot be derogated by these general terms and conditions, Italian law shall apply and the competent court shall be the one having jurisdiction over the territory of the municipality of Graun im Vinschgau.
Art 17 Generic Masculine
For ease of understanding, these general terms and conditions use the generic masculine form. However, these general terms and conditions apply to all persons making a purchase, regardless of gender.
Art 18 Amendment of the general terms and conditions
Schöneben AG reserves the right to amend these general terms and conditions. Changes will be published immediately on the website and will be effective for subsequent purchases from the time of publication. Tickets purchased prior to the change will not be affected by the change.
